Please review the following terms carefully as they apply to any introduction made or list of Third-Party Lifestyle Service Providers (“Providers”) provided pursuant to Element Pointe Plus, including the Providers currently included or that may be added in the future. Your request for an introduction to or a list of these Providers constitutes an agreement to these terms.

You understand, agree, and acknowledge that the Firm:

  • Is not acting as an agent for you or any Provider and any introduction to any Provider by the Firm should in no way be considered a solicitation by the Firm for business on behalf of the Providers.
  • Is not endorsing, advising on, providing a warranty for, or guaranteeing the Providers or any services they may offer or provide.
  • May not be deemed to have provided advice, or endorsement in connection to your engagement of a Provider or any services provided.
  • Will not assume any expense or other responsibility related to the engagement of any Provider or any services provided.
  • Is not obliged to perform, and you will not rely on the Firm to perform due diligence on or review, examine, monitor, assess, or inform you regarding the quality, adequacy, or suitability of the Providers or their services. Any review that the Firm may have conducted on any Provider was based on information from sources that we believe to be reliable, but we cannot guarantee its accuracy or completeness.

You must make an independent decision to engage a service provider based on your own due diligence and any advice you may receive from your own advisers as needed, and not on any views or opinions expressed by the Firm.

  • Your point of contact for any information or documentation regarding Provider services will be the personnel of the Provider, and not any employee or associated person of the Firm.
  • Your engagement of any of these Providers is your decision and responsibility, and you accept any risks or costs associated with such engagement. If you require advice regarding any legal, tax, business, accounting, investment, or other matters, you will consult with the appropriate advisor.
  • Providers are not agents, affiliates, representatives, subcontractors, or any other associated persons of the Firm, and your relationship with a Provider will be governed by any agreement you and the Provider enter into and not any agreement you have with the Firm.
  • Your Firm account statements or other documents and information the Firm makes available to you will not reflect any information regarding any services from a Provider.
  • Nothing in this document shall be construed as giving rise to any duty of care owed to or advisory relationship with you or any Provider, and the Firm will have no ongoing role and no obligation to you to assist with, oversee, direct, or monitor the services provided by the Provider.
  • Providers may offer other services apart from those for which the Firm has provided an introduction. An introduction to one service does not constitute an introduction for any other services a Provider may offer. You should conduct your own due diligence and consult with your own advisors before engaging a Provider for other services.
  • Some Providers may offer you more favorable pricing because you are a client of the Firm. However, the Firm does not receive any revenue or compensation from these Providers for introducing the Firm’s clients. Ask the Provider about pricing for Firm clients.
